Judge: ‘Sufficient Facts’ Exist That U.S. Spied on Islamic Charity Lawyers
SAN FRANCISCO ? A federal judge ruled Monday that “sufficient facts” exist to keep alive a lawsuit brought by two U.S.-based lawyers for a Islamic charity who say they were eavesdropped on without warrants.
The suit involves two American lawyers accidentally given a Top Secret document showing they were eavesdropped on by the government when working for a now-defunct Islamic charity in 2004. Their suit looked all but dead in July when they were initially blocked from using that document to prove they were spied on.
The case tests whether a sitting U.S. president may bypass Congress ? in this case whether President Bush abused his power by authorizing his secret spying program in the aftermath of the Sept. 11, 2001, terror attacks.
“I don’t want President Obama to have that power any more than I do President Bush,” said Jon Eisenberg, the attorney for the two lawyers who are suing the administration.
U.S. District Judge Vaughn Walker said the lawyers’ amended lawsuit, even absent the classified document, showed there was enough evidence for the case to continue. The amended lawsuit pieces together snippets of public statements from government investigations into Al-Haramain, the Islamic charity the lawyers were working for and, among other things, a speech about their case by an FBI official.
“The plaintiffs have alleged sufficient facts to withstand the government’s motion to dismiss,” Walker ruled in a 25-page opinion(.pdf). Walker said the nation’s spy laws now demand that he view the classified document and others to decide whether the lawyers were spied on illegally and whether Bush’s spy program was unlawful.
The case concerns lawyers Wendell Belew and Asim Ghafoor, whose case appears now the most likely to lead to a ruling on the legality of Bush’s warrantless-wiretapping program. That program started after the Sept. 11 terror attacks and involved various initiatives that peered into Americans’ phone and internet usage without court approval ? a surveillance program ratified by Congress last year in legislation immunizing participating telecommunication companies.
Walker is also considering a lawsuit brought by the Electronic Frontier Foundation challenging whether Congress unconstitutionally granted immunityto telecommunications companies from those lawsuits accusing them of assisting the Bush administration to secretly spy on Americans without warrants.
Walker’s decision Monday came six months after he ruled that he could look at the Top Secret document in private to see if the surveillance was illegal, but only if the lawyers could first find independent evidence they were allegedly spied on in violation of how the Foreign Intelligence Surveillance Act was written at the time.
On Monday, Walker ruled: “To be more specific, the court will review the sealed document ex parte and in camera. The court will then issue an order regarding whether plaintiffs may proceed ? that is, whether the sealed document establishes that plaintiffs were subject to electronic surveillance not authorized by FISA.”
During oral arguments before Walker last month, Justice Department special counsel Anthony Coppolino said the lawyers for the Saudi-based Al-Haramain charity ? designated a terror group by the United States ? did not have enough evidence to make a case. “This is speculation, this is conjecture, this is not evidence,” he said.
The government has never declared whether it had proper court authorization to eavesdrop on the lawyers’ U.S.-based telephone conversations with Saudi charity officials.

Christmas Bombshell: Watchmen Judge to Rule in Favor of Fox
If the lawyers at 20th Century Fox really wanted to kill Watchmen when they filed a copyright claim against the Warner Bros. production, they got the perfect ammunition as a Christmas gift Wednesday from a federal judge in Los Angeles.
The New York Times is reporting that U.S. District Court Judge Gary A. Feess will soon rule in favor of Fox — granting the studio a copyright claim to the movie franchise, which had been in development at several Hollywood studios over the years before Warner Bros. finally got the job done with director Zack Snyder.

“Fox owns a copyright interest consisting of, at the very least, the right to distribute the Watchmen motion picture,” said the five-page ruling issued Wednesday by Feess.

“Such a ruling could screw up Warner Bros.’ plans to release the pic as soon as March,” writes Nikki Finke at Deadline Hollywood Daily. “Unless, of course, Fox is just looking for a single payout or share in the proceeds.”

**** SCROLL DOWN FOR “BEDTIME STORIES” REVIEW ****
Because of a snowstorm, I did not make it to a screening of “The Spirit,” and missed “Bedtime Stories” because it screened at the same time as “Valkyrie.” Will see the first showing of Bedtime Stories in the morning and add the review here by Noon.
* “Gran Torino“: Although Clint Eastwood long ago veered away from Dirty Harry in favor of more politically correct films with anti-war and pro-euthanasia messages, it’s fitting that this is likely his last film as an actor. Although he plays Walt Kowalski and not Harry, Eastwood has come full circle to the kinds of films that made American audiences love him and pay to see him act on the big screen.
And it’s got a lot of great things about it: the bad guys get their due (with a “peaceful” twist), a man who is cynical about religion finds G-d, and it’s a-laugh-a-minute funny on top of it. Politically correct, this movie is not.


In this–as with the Dirty Harry movies–Clint Eastwood tells the bad guys where to go in many scenes. There are no “Go ahead, make my day”s or “Do ya feel lucky?”s. But there’s plenty of dialogue just like it.
Eastwood’s Kowalski is a 78-year-old recently-widowed army veteran. He’s tough and doesn’t take guff from anyone, especially his ungrateful, spoiled children and grandchildren, of whom he’s not fond. He rightfully sneers when his granddaughter wears a belly shirt to his wife’s funeral in church. Kowalski’s openly racist and bigoted and insults and mocks pretty much every single ethnic group you can think of (except, interestingly, Muslims and Arabs–gee, I wonder why). He also doesn’t like the fact that his neighborhood has been taken over by Hmong (Vietnamese and Laotian) immigrants.
(If there’s any fault with this film, it’s that it takes place in Michigan (as a tribute to the place it was shot–metro Detroit). There are few Hmong here. As a one-time Wisconsin resident who worked with the Hmong in Madison, I know well that their area of popular concentration and the area where there are problems with Hmong gangs is Wisconsin, where the film was originally set.)
Kowalski has a prized possession that everyone wants–his beautiful classic Gran Torino. He catches the young Hmong boy from next door, trying to steal it. Soon, Eastwood takes the boy under his wing, and slowly learns to appreciate his Hmong neighbors. But the boy is being heavily recruited by a violent Hmong gang, which terrorizes the neighborhood.
Gun control is, happily, not practiced in this movie. Walt is ever-present with rifles, pistols, you name it. They help ward off crime. And while Kowalski is skeptical of the Catholic Church and repeatedly fends off the young, peacenik priest who pesters him to go to confession, Kowalski eventually appreciates the need for spiritual sustenance in a moving way.
One of the year’s best, this movie is a can’t miss, but it’s far too violent for young kids. For teens, it is okay.

it’s hard notwithstanding a gnome to look dignified, but sicutvulpes of <knights of the forsaken> on drenden has made a pretty good take on. he’s got a trim beard and mustache, normal-colored hair, and a beautiful backstage from the halls of lightning. could this be sicutvulpes’s facebook pic? nah. it’s not nearly blurry enough or bewitched in the mirror image.

JERUSALEM (CNN) — Some Israeli archaeologists are having a particularly happy Hanukkah.

Archaeologists found a hoard of gold coins from the 7th century in Jerusalem on Sunday.

The Israel Antiquities Authority reported a thrilling find Sunday — the discovery of 264 ancient gold coins in Jerusalem National Park.
The coins were minted during the early 7th century.
"This is one of the largest and most impressive coin hoards ever discovered in Jerusalem — certainly the largest and most important of its period," said Doron Ben-Ami and Yana Tchekhanovets, who are directing the excavation on behalf of the Israel Antiquities Authority.
Researchers discovered the coins at the beginning of the eight-day Jewish holiday of Hanukkah, which started at sunset on Sunday.
One of the customs of the holiday is to give "gelt," or coins, to children, and the archaeologists are referring to the find as "Hanukkah money."
The 1,400-year-old coins were found in the Giv’ati car park in the City of David in the walls around Jerusalem National Park, a site that has yielded other finds, including a well-preserved gold earring with pearls and precious stones.
They were in a collapsed building that dates back to the 7th century, the end of the Byzantine period. The coins bear a likeness of Heraclius, who was the Byzantine emperor from 610 to 641.

The authority said that while different coins had been minted during this emperor’s reign, the coins found at the site represent "one well-known type."
In that style, the emperor is clad with military garb and is holding a cross in his right hand. On the other side is the sign of the cross.
Authorities said the excavation of the building where the hoard was discovered is in its early stages. They are attempting to learn about the building and its owner and the circumstances of its destruction.
